Adoption Terms & Conditions

1. About the Adopt a Feature scheme

The Adopt a Feature scheme offers supporters the opportunity to make a meaningful contribution towards the restoration, preservation and future of Jumbo Water Tower, while receiving a commemorative association with an architectural feature of the iconic tower.

For the purposes of these Terms & Conditions, “Jumbo” or “Jumbo Water Tower” refers to The Balkerne Water Tower in Colchester.

Adopting a feature is a commemorative arrangement and does not constitute the purchase or ownership of a physical part of Jumbo Water Tower or rights relating thereto or derived therefrom.

2. Feature allocation

Features are subject to availability and are allocated entirely at the discretion of NEH.

Supporters are not entitled to select or reserve a particular feature. NEH will allocate an available feature to each successful adoption.

NEH may, where reasonably practicable, provide information about the feature associated with an adoption, but the allocation of features remains solely at NEH’s discretion.

3. What adoption means

An Adopt a Feature contribution provides the supporter with a 20-year commemorative adoption associated with an allocated feature.

The adoption does not provide the supporter with:

• ownership of the physical feature;
• any legal or beneficial interest in the feature or the building or any rights relating to it or derived therefrom;
• rights to control, alter, remove or access the feature;
• exclusive access to Jumbo Water Tower;
• free admission to Jumbo Water Tower; or
• free admission to any event or activity organised by NEH, The Jumbo Project or its partners.

The adoption is a commemorative recognition of the supporter’s contribution towards Jumbo’s future.

4. Duration of adoption

Each adoption will run for 20 years.

The 20-year adoption period will begin on the date that Jumbo Water Tower is officially opened to the public following its restoration, or if applicable, after the payment of the full contribution.

This applies irrespective of when the adoption was purchased. Supporters who adopt a feature before the building reopens will therefore receive the full 20-year adoption period from the official public opening date.

The current anticipated opening date is not guaranteed and may change as the restoration project progresses.

Adoptions cannot be extended, shortened, amended or transferred once purchased except at NEH’s discretion if circumstances require.

5. Payment

The cost of adopting a feature may be paid:

• as a single payment; or
• by ten monthly instalments.

The price applicable to an adoption is the price advertised and agreed at the time of purchase. NEH reserves the right to change the price of future or new adoptions without affecting the price already paid or committed to by existing supporters.

6. Monthly instalments

By choosing the instalment option, the supporter agrees to make ten monthly payments via Direct Debit.

NEH will reserve an adoption allocation for the supporter while the instalment payments are being made. However, the adoption does not become active until the full amount has been received.

If instalment payments are missed, cancelled or otherwise not completed, NEH reserves the right to cancel the adoption.

No refund will be provided for payments already received. Any funds received will be retained by NEH and used in support of the Love Jumbo campaign and/or future NEH activity.

A supporter whose instalment arrangement has been cancelled will need to submit a new application if they wish to adopt a feature in the future. Any new application will be subject to the availability and pricing applicable at that time.

7. Adoption pack and certificate

Once the full price has been paid, supporters will receive:

• a digital certificate, which will normally be issued within one week of full payment; and
• a physical adoption pack, which will normally be sent within one month of full payment.

The physical adoption pack and certificate are commemorative materials and do not represent ownership of, or provide access to, the physical feature.

8. Adoption name and dedication

Each supporter may submit:

• an adoption name, and
• a personal dedication of up to 90 characters.

The adoption name may be displayed on the digital display within the site.

The 90-character dedication will appear on the supporter’s personalised certificate and may also be published on a dedicated dedications page on the Jumbo website.

Businesses and organisations may adopt a feature and use their business or organisation name as their adoption name. Dedications must remain commemorative in nature and must not be used for advertising, marketing or promotional purposes.

9. Dedication approval and publication

NEH reserves the right to refuse an application for adoption and/or refuse any proposed adoption name or dedication.

This includes, but is not limited to, wording that NEH considers:

• rude, offensive, abusive or derogatory;
• discriminatory or hateful;
• defamatory;
• politically partisan or intended to promote a political party or campaign;
• commercial, promotional or advertising in nature;
• likely to infringe another person’s intellectual property or other rights;
• misleading or intended to impersonate another individual or organisation; or
• likely to damage the reputation of NEH, Jumbo Water Tower or the wider project.

NEH may refuse or remove inappropriate wording at its discretion and is not required to provide advance warning before doing so.

Supporters are responsible for checking the spelling, punctuation and accuracy of their submitted name and dedication.

NEH will not be responsible for correcting, editing or checking names or dedications before publication. Names and dedications will be reproduced as submitted at the time of adoption, subject to any refusal under these Terms & Conditions.

10. The dedication display

The supporters’ display may take the form of a physical board, digital display or other appropriate commemorative display determined by NEH.

The display will be located somewhere within the Jumbo Water Tower site but is not guaranteed to be located inside the water tank itself.

NEH reserves the right to determine the format, location, design and presentation of the supporters’ display.

11. The restoration project

Jumbo Water Tower is an historic building and its restoration, construction, maintenance and preservation may require changes to the tank and other architectural features.

As part of the restoration of the water tank, NEH reserves the right to alter, restore, repair, move, remove, replace or otherwise modify the tank panels/struts and their visual appearance where this is necessary to deliver the restoration project or ensure the long-term preservation of the building or comply with any directions of the local planning authority or Historic England.

Supporters acknowledge that the appearance of the tank panels and other architectural features following restoration may differ from their appearance at the time of adoption.

In particular, the restoration of the tank will include the addition of an external façade, which will alter the way the tank panels are seen from outside the building. As a result, the adopted panels may no longer be directly visible, or may have a substantially different external appearance, when viewed from outside Jumbo Water Tower following completion of the restoration.

The external façade and other restoration works may also affect the visibility, accessibility and presentation of individual architectural features. Adoption does not provide any right to view, access or otherwise interact with the physical feature.

Where an adopted feature is moved, repaired or replaced, the supporter’s commemorative adoption will remain valid for the remainder of the 20-year adoption period.

Where a feature is replaced, NEH may transfer the commemorative adoption to the replacement feature, and the supporter will not acquire any ownership or rights in either the original or replacement feature.

Supporters acknowledge that the restoration and future maintenance of Jumbo Water Tower may result in changes to the appearance, position and visibility of architectural features, and to the external appearance of the water tank. Such changes do not constitute a change to the supporter’s commemorative adoption and will not entitle the supporter to a refund or cancellation.

12. Changes to the restoration project

NEH is committed to the restoration, preservation and future of Jumbo Water Tower. However, restoration and construction projects can be affected by circumstances outside NEH’s control, including funding, planning, construction, technical, legal, operational or other considerations.

NEH therefore reserves the right to alter, postpone, reduce, expand or otherwise change aspects of the restoration project and the future use or operation of Jumbo Water Tower.

Such changes will not automatically entitle supporters to a refund or cancellation of their adoption.

If the restoration project is not completed, NEH may contact supporters to discuss appropriate options for transferring or redirecting their support towards another aspect of the Love Jumbo campaign, the future of Jumbo Water Tower or other appropriate NEH activity.

13. Cancellation, refunds and revocation

Adopt a Feature contributions are non-refundable.

Once an adoption has been purchased, the supporter is not entitled to a refund, including where they subsequently change their mind, cease payment or are unable to make use of the commemorative adoption.

NEH reserves the right to revoke an adoption where it considers that the supporter has:

• provided false or misleading information;
• behaved abusively, threateningly or inappropriately towards NEH staff, volunteers, contractors, visitors or partners;
• submitted or subsequently been associated with inappropriate, offensive or prohibited wording;
• misused the name, reputation or identity of Jumbo Water Tower or NEH; or
• acted in a manner that could reasonably bring NEH, its trustees, Jumbo Water Tower or the project into disrepute.

Where an adoption is revoked, no refund will be provided, including where the full £500 contribution has already been paid. NEH will retain funds received and may use them in support of the Love Jumbo campaign and/or future NEH activity.

14. Transfer of adoption

Adoptions are personal to the supporter and cannot be transferred, sold, assigned or otherwise passed to another person or organisation.

The adoption cannot be amended to change the named supporter during the 20-year adoption period.

In the event of the death of an individual supporter, the adoption will remain in the original supporter’s name for the remainder of the 20-year adoption period.

Family members or others who wish to commemorate the supporter may choose to make a separate Adopt a Feature contribution, subject to availability and the terms applying at that time.

15. Photography and publicity

By participating in the Adopt a Feature scheme, supporters acknowledge that NEH may use the supporter’s name and approved adoption details in connection with the scheme and the promotion of Jumbo Water Tower and the Love Jumbo campaign.

NEH may also photograph or film events, ceremonies, visits and activities connected with the Adopt a Feature scheme.

Where an identifiable supporter is photographed or filmed for publicity purposes, NEH will seek appropriate permission where required.

Photographs and video may be used by NEH in connection with Jumbo Water Tower and its fundraising, restoration, heritage and community activities, including on:

• the NEH and Jumbo websites;
• social media;
• printed publications;
• newsletters;
• press and media coverage;
• fundraising materials; and
• promotional materials relating to Jumbo Water Tower and NEH.

Supporters who do not wish to be photographed or filmed should inform a member of the NEH team before participating in an event or activity.

16. Data protection and privacy

NEH will collect and process personal information provided as part of the Adopt a Feature scheme in accordance with applicable UK data protection legislation and NEH’s privacy and data protection policies.

17. Changes to these Terms & Conditions

NEH reserves the right to update or amend these Terms & Conditions where reasonably necessary, including to reflect changes to legislation, the restoration project, the operation of the Adopt a Feature scheme or the future use of Jumbo Water Tower.

Any changes will not retrospectively alter the agreed 20-year adoption period or the price paid or committed to by an existing supporter.

18. General

Participation in the Adopt a Feature scheme does not guarantee that Jumbo Water Tower will open on a particular date or that any particular facilities, events, exhibitions or activities will be available following its restoration.

The Adopt a Feature scheme is intended as a commemorative fundraising initiative supporting the work of NEH and the future of Jumbo Water Tower.

Nothing in these Terms & Conditions gives a supporter any ownership, tenancy, licence, access right or other proprietary interest in Jumbo Water Tower or any part of the building or any rights relating to it or derived therefrom.
